Humlog aayatullaah sistani aur aayatullah khamenei Rehbar ke fatwe ko ek sath nahi maan sakte ?
Yaani ek sath dono ki taqleed mein nahi reh sakte?

سلام عليكم
aap ka sawaal taqlid me " tabeiz " ( تبعیض ) ke baare me hai yaani keya aek hi waqt me mota'addid wa mokhtalif mujtahid ki taqlid kar sakte hain ? ya keya baaz masaa'ael me aek mujtahid ke fatwa ke motaabiq our baaz dusre maasaa'ael me dusre mujtahid ke fatwa ke motaabiq amal kar sakte hain ?
is ki chand suraten hain :
1. tamaam ahkaam wa masaa'ael me aek hi mujtahid , aalam ( اعلم ) hai
2. baaz masaa'ael me aek mujtahid aalam hai our baaz dusre masaa'ael me dusra mujtahid aalam hai ...
3. aalamiyat ( aalam hone ) me sab mosaawi wa yaksaan hain
pahli surat me dusre ki taqlid nahi ki jaa sakti hai is liae ke mujtahid ( marja ) ke sharaa'aet me se aek shart aalamiyat hai
dusri surat me jo mujtahid jis mas'ale me aalam hai ousi mas'ale me ous ( aalam ) ki taqlid karna waajib wa zaruri hai
Misaal :
namaaz ke masaa'ael me aek mujtahid aalam hai our roza ke masaa'ael me dusra aalam hai our shaadi ( izdewaaj ) ke masaa'ael me tisra mujtahid aalam hai ...
to namaaz ke masaa'ael me jo aalam hai ous ki taqlid karen our roza ke masaa'ael me dusre aalam ki our shaadi ke ahkaam me tisre aalam mujtahid ki taqlid karen ...
is surat me mota'addid wa mokhtalif mujtahid ki taqlid karen yaani jo jis mas'ale me aalam hai ous mas'ale me ous ki taqlid karna waajib wa laazim hai
tisri surat me jis mujtahid ke fatwa ke motaabiq amal karna chaahen to amal kar sakti hain jaa'aez hai
is ki 2 surat hai :
1. namaaz wa roza ke masaa'ael me aek mujtahid ki our khums me dusre mujtahid ki our shaadi waghirah ke ahkaam me tisre mujtahid ki taqlid ki jaa sakti hai jaa'aez hai
2. kuch muddat wa arse tak aek mas'ala me aek mujtahid ke fatwa ke motaabiq amal kar sakti hain our kuch muddat wa arsa guzar jaane ke baad ousi mas'ale me dusre mujtahid ki nazar wa fatwa ke motaabiq amal kar sakti hain jaa'aez hai
wazaahat :
wo masaa'ael jin ka rabt wa ta'alluq aek dusre se hai chunaan'cheh ( چنانچہ ) mujtahedin ke fatwa par amal karna , amal ke baatil hone ya hukm ki qat'ei wa yaqini mokhaalefat ka sabab bane to is surat me taqlid me tab'eiz yaani mokhtalif wa mota'addid mujtahid ki taqlid jaa'aez nahi hai
jaiyse badan wa lebaas ke mota'alliq ahkaam-e-najaasat me aek mujtahid ke fatwa ke motaabiq our namaazi ke ahkaam-e-lebaas me dusre mujtahid ke fatwa ke motaabiq amal kare ( yahaan ya is ke maanind jaghon me mokhtalif mujtahid ki taqlid jaa'aez nahi hai )
Note :
1. aayatullaah sistaani ke fatwa ke motaabiq eilm me mosaawi wa baraabar hone ki surat me mokhtalif mujtahedin ki taqlid ous waqt jaa'aez hai jab mujtahedin fatwa dene ke ta'alluq se ( ifta me ) taqwa our wara ( ورع ) me bhi mosaawi wa baraabar hon ( yaani fatwa dene me jo omur mohim hain ous me tahqiq wa aehteyaat karne me bhi mosaawi hon )
2. Aalam se moraad :
mujtahid ka eilm , ijtehaad ke tamhidi wa ibtedaaei oumur ( moqaddemaat ) jaiyse loghat , hadis , rejaal , fiqh wa osul-e-fiqh ... ke zariae ahkaam-e-aelaahi akhz ( اخذ ) karne me dusre mujtahedin se zeyaadah ho
3. mota'addid wa mokhtalif mujtahid ke hawaale se jo bayaan kiya gaya ous ka rabt taqlid me ibtedaaei tabeiz se hai yaani moqallid ko mokhtalif mujtahid ke fatwa ke motaabiq amal karne ka aekhteyaar amal wa taqlid karne ke pahle hai agar kisi mujtahid ki nazar ke motaabiq amal wa taqlid ke baad dusre mujtahid ke fatwa par amal karna chaahti hain to is surat me roju wa odul ka hukm jaari hoga ( agar dusre mujtahid ki aalamiyat saabit ho jaae to pahle ke bajaae dusre ki taqlid karen )
